A2P 10DLC & SMS Compliance Addendum

This Addendum governs all text messaging (SMS/MMS) traffic initiated through the Kaijova platform to phone numbers within the United States.

1. Mandatory Carrier Registration

  • The 10DLC Requirement: US telecommunication carriers require all businesses sending Application-to-Person (A2P) text messages over standard 10-digit long code (10DLC) phone numbers to register their Brand and Campaign.

  • Client Responsibility: As a user of Kaijova LLC, you agree to provide accurate business registration details (including your EIN/Tax ID and physical address) so we can register your brand.

  • Vetting Fees: You are responsible for any registry vetting fees levied by carriers or upstream API providers to approve your SMS campaigns.

2. Strict Opt-In Consent Rules

You are legally prohibited from sending text messages to any recipient unless you have obtained explicit, verifiable opt-in consent.

  • Website Forms: If collecting phone numbers on a website or landing page, you must include a checkbox stating: "By providing your phone number, you agree to receive text messages from [Your Business Name]. Message and data rates may apply. Reply STOP to opt-out."

  • No Pre-Checked Boxes: The consent checkbox must not be pre-checked.

  • Forbidden Data: You may not send messages to phone numbers purchased, rented, or scraped from third-party lists.

3. Required Message Formatting

Every initial text message sent through the Kaijova Platform must clearly identify your business name and provide an opt-out mechanism.

  • Example: "Hi [Name], this is Kaijova LLC. Thanks for booking an appointment. Reply STOP to unsubscribe."

4. Opt-Out (STOP) and Help Commands

  • Automated Processing: Our Platform automatically processes keywords like STOP, END, QUIT, UNSUBSCRIBE, and CANCEL.

  • Immediate Deactivation: Once a lead replies with an opt-out keyword, the Platform will block future texts to that number. You agree not to bypass this block.

5. Prohibited SMS Content Categories

US carriers strictly ban certain topics on A2P 10DLC routes. You agree never to use Kaijova to send messages related to:

  • High-interest loans, debt collection, or credit repair.

  • Cannabis, CBD, vaporizers, fireworks, or controlled substances.

  • Work-from-home schemes, multi-level marketing (MLM), or crypto scams.

  • Gambling, adult content, or hate speech.
